What is cottage food law?

Michigan's Cottage Food Law, which went into effect in 2010, allows small businesses to make and sell certain non-hazardous foods from their homes. The law includes the following guidelines:

Preparation

Foods must be prepared in the primary residence's unlicensed home kitchen. This can be a free-standing home, apartment, or condo, but not a second home, vacation cottage, or commercial kitchen. Raw meats should not be prepared while making cottage foods. Before preparing, wash, rinse, sanitize, and air-dry all equipment, dishes, utensils, and food preparation surfaces.

Labeling

Foods must be packaged and labeled according to MDARD standards. Labels must include ingredients, allergen labeling, and a statement that the food was made in a home kitchen that has not been inspected by the Michigan Department of Agriculture.

Sales

Cottage food businesses can sell directly to consumers at venues like craft fairs, farmers' markets, pop-up selling events, and roadside stands. They can also take direct orders. However, businesses cannot earn more than $25,000 in gross sales per year before expenses. If sales exceed $25,000, a licensed kitchen is required for production.

Foods

The law allows the preparation of certain non-hazardous foods, such as baked goods, jams, jellies, candy, snack foods, cereal, granola, dry mixes, vinegar, and dried herbs. However, it does not apply to canned or fermented goods like kombucha, tomato sauce, salsa, or fruit butter.
